Terms & Conditions

2.1 Minimum Age. You must be at least 18 years of age to use the Service. By creating an account or using the Service, you represent and warrant that you are at least 18 years old. The Service contains AI-generated content intended for adults only, including content that may be explicit or mature in nature.

2.2 Age Verification. You will be required to confirm your age upon first use. We reserve the right to terminate or suspend any account where we have reasonable grounds to believe the User does not meet the minimum age requirement.

2.3 Legal Capacity. You represent that you have the legal capacity to enter into a binding agreement and that your use of the Service complies with all applicable laws and regulations in your jurisdiction.

3.1 Account Creation. To use the Service, you must create an account through our authentication provider, Clerk. You agree to provide accurate, current, and complete information during registration.

3.2 Account Security. You are responsible for maintaining the confidentiality of your account credentials, including any API keys you create. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized access to your account.

3.3 API Keys. You may generate API keys to access the Service programmatically. You are responsible for safeguarding your API keys and are liable for all activity conducted through them. API keys are hashed upon creation and cannot be recovered if lost.

3.4 One Account Per Person. Each individual may maintain only one account. Creating multiple accounts to circumvent restrictions or abuse the Service may result in termination of all associated accounts.

4.1 AI Character Chat. TuringMate provides an AI-powered chat platform where Users interact with AI characters. Characters maintain persistent memory of conversations, can generate and analyze photos, and simulate realistic conversational behaviors.

4.2 Character Creation. Users may create custom AI characters with defined personalities, appearances, and behaviors. Characters created by Users may be set as public (accessible to all Users) or private (accessible only to the creator). All Characters must be depicted as being 18 years of age or older. Users must not create, upload, or configure any Character that is described, portrayed, or implied to be under the age of 18.

4.3 Photo Features. The Service includes features for uploading photos, AI-generated image creation, photo analysis, and facial recognition. These features use third-party AI and cloud services as described in our Privacy Policy.

4.4 API Access. Developers may access the Service via a REST API to integrate AI characters into their own applications. API usage is subject to these Terms and all applicable rate limits.

4.5 API Disclosure Requirement. If you integrate TuringMate characters into your own applications via the API, you must clearly disclose to your end-users that the characters they are interacting with are AI-generated and not real people. This disclosure must be prominently displayed before or during the user's first interaction with a character. Failure to provide adequate disclosure may result in suspension or termination of your API access.

4.6 Proactive Messaging. Characters may initiate conversations with Users based on configured outreach settings. You may control these preferences through your privacy settings and may opt out at any time.

4.7 Analytics & Session Recording. We use Mixpanel to collect product analytics, session recordings, and heatmap data to understand how Users interact with the Service and to improve the user experience. Session recordings capture visual replays of your browsing sessions on TuringMate, including page content, mouse movements, and clicks. Sensitive payment fields (card numbers, CVV codes) are automatically masked and never recorded. By using the Service, you consent to this data collection as further described in our Privacy Policy. You may disable session recordings by enabling your browser's "Do Not Track" setting.

5.1 Credit System. The Service operates on a credit-based model. Each text message sent (via the web interface or API) consumes 1 credit. Photo messages (messages containing images) consume 2 credits. Credits must be purchased in advance through available credit packages.

5.2 Pricing. Credit packages are offered at prices displayed on the Service at the time of purchase. We reserve the right to modify pricing at any time. Price changes do not affect credits already purchased.

5.3 Free Credits. New Users receive a limited number of free credits upon registration. Additional bonus credits may be awarded for completing profile setup. Free credits have no monetary value and may not be transferred or refunded.

5.4 No Refunds. All credit purchases are final. Credits are non-refundable, non-transferable, and have no cash value, except as required by applicable law. Unused credits do not expire.

5.5 Payment Processing. Payment information is processed securely. We store only the last four digits and brand of your payment card for transaction history purposes. Full payment card details are not stored on our servers.

6.1 Your Content. You retain ownership of any Content you upload, create, or transmit through the Service, including messages, photos, and character definitions. By submitting Content, you grant TuringMate a worldwide, non-exclusive, royalty-free license to use, store, process, and display your Content solely for the purpose of operating and improving the Service.

6.2 Content Moderation. All user-submitted content is subject to automated moderation using third-party services (including OpenAI's moderation API) to detect and filter prohibited content. We reserve the right to remove any Content that violates these Terms.

6.3 Character Content. Characters you create and set as public may be accessed and interacted with by other Users. You are responsible for ensuring that your public characters do not violate these Terms or applicable laws.

6.4 Photo Uploads. Photos you upload are stored using third-party cloud services (Cloudinary and AWS S3). Uploaded photos may be analyzed by AI services for the purpose of providing features such as facial recognition, content analysis, and character interaction. By uploading photos, you represent that you have the right to share them and consent to their processing as described in our Privacy Policy.

6.5 Facial Recognition. The Service uses facial recognition technology (powered by AWS Rekognition) to identify individuals across photos within your conversation sessions. This data is scoped to individual sessions and is not shared across Users. By using photo features, you consent to this processing.

You agree not to:

• Use the Service if you are under 18 years of age.
• Upload, transmit, or create Content depicting real minors or content that sexualizes minors in any way.
• Create, configure, or use any Character that is described, portrayed, or implied to be under 18 years of age. All Characters on the platform must represent individuals who are 18 years of age or older.
• Upload photos of individuals without their consent, particularly for use with facial recognition features.
• Attempt to circumvent content moderation, age verification, or safety systems.
• Use the Service to harass, threaten, defame, or abuse any person.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Use the API in a manner that exceeds reasonable use or imposes an unreasonable load on our infrastructure.
• Create characters designed to impersonate real individuals without authorization.
• Use the Service for any unlawful purpose or in violation of any applicable local, national, or international law.
• Share, sell, or transfer your account or API keys to third parties.
• Use automated tools (bots, scrapers) to access the Service outside of the provided API.

8.1 Nature of AI Content. All text, images, and responses generated by AI characters are produced by artificial intelligence models. AI-generated content is fictional and should not be relied upon for factual information, advice, or decision-making.

8.2 No Endorsement. TuringMate does not endorse, verify, or guarantee the accuracy, completeness, or reliability of any AI-generated content. Interactions with AI characters do not constitute professional advice of any kind (legal, medical, financial, psychological, or otherwise).

8.3 Image Generation. AI-generated images are produced using third-party AI models (including Google Gemini and other providers). These images are synthetic and may not accurately represent real people, places, or things. You acknowledge that AI-generated images may sometimes produce unexpected or inappropriate results despite safety measures.

8.4 Mature Content. The Service may generate or display content of a mature, explicit, or adult nature (NSFW). By using the Service, you acknowledge and accept that you may encounter such content. Age verification is required for this reason.

8.5 Character Age Requirement. All AI Characters available on the Service — whether created by TuringMate or by Users — are depicted as being 18 years of age or older. Any Character found to depict, describe, or imply an individual under 18 years of age will be removed, and the associated account may be suspended or terminated. Users must not attempt to use prompts, character configurations, or any other means to circumvent this requirement.

9.1 Our Property. The Service, including its design, code, logos, trademarks, and all proprietary content, is the exclusive property of TuringMate or its licensors. You may not copy, modify, distribute, or create derivative works based on any part of the Service without prior written consent.

9.2 AI-Generated Output. AI-generated text and images produced through the Service are provided for your personal use. Ownership and intellectual property rights in AI-generated output may be subject to applicable laws in your jurisdiction. We make no claims of ownership over AI-generated output produced in response to your inputs.

9.3 Feedback. Any feedback, suggestions, or ideas you provide regarding the Service may be used by us without obligation to you.

10.1 Webhook Delivery. The Service provides webhook functionality to deliver proactive messages and events to your configured endpoints. Webhook payloads are signed using HMAC-SHA256 for verification. You are responsible for securing your webhook endpoints and validating signatures.

10.2 Endpoint Availability. We make reasonable efforts to deliver webhook events but do not guarantee delivery. Webhooks that repeatedly fail may be automatically disabled. You are responsible for monitoring and maintaining your webhook endpoints.

10.3 Third-Party Integrations. If you integrate the Service with third-party applications through the API, you are responsible for compliance with both these Terms and the terms of the third-party services.

10.4 End-User Disclosure Obligation. When using the API or webhooks to deliver AI character interactions to end-users in your own applications, you must: (a) clearly and conspicuously inform end-users that they are communicating with an AI, not a real person; (b) not present AI characters as human beings or conceal their artificial nature; and (c) comply with all applicable laws regarding AI-generated content disclosure in your jurisdiction. You are solely liable for any claims arising from your failure to provide adequate disclosure to your end-users.

11.1 Termination by You. You may stop using the Service at any time. To delete your account and associated data, please contact us at support@turingmate.com.

11.2 Termination by Us. We may suspend or terminate your account at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately.

11.3 Effect of Termination. Upon termination, your access to the Service will be revoked. Any unused credits will be forfeited unless a refund is required by applicable law. We may delete your data in accordance with our Privacy Policy.

To the maximum extent permitted by applicable law, TuringMate and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service, including but not limited to:

• Loss of profits, data, or goodwill.
• Damages arising from AI-generated content, including inaccurate, offensive, or harmful content.
• Damages resulting from unauthorized access to your account or API keys.
• Damages arising from third-party services used by the platform.
• Service interruptions or downtime.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TuringMate operates, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.

Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement. These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and TuringMate regarding the Service.

Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights at any time without notice.
