AI characters are not real people. Their personalities, opinions, memories, emotions, and behaviors are simulated by machine learning models. AI characters do not have consciousness, feelings, or genuine understanding. All AI characters on the platform are depicted as being 18 years of age or older.

AI-generated content may be inaccurate, misleading, incomplete, biased, or factually wrong. Despite our efforts to implement safety measures and content moderation, AI models may produce unexpected, inappropriate, or harmful content. We make no representations or warranties regarding the accuracy, reliability, or suitability of any AI-generated content.

AI-generated images are synthetic and do not depict real individuals, unless a user has uploaded reference photos. Any resemblance to real persons in AI-generated images is coincidental.

The Service is provided for entertainment purposes only. Interactions with AI characters do not constitute and should never be treated as:

• Medical or health advice — Do not use AI character responses to diagnose, treat, or manage any medical condition. Always consult a qualified healthcare professional.
• Mental health or psychological counseling — AI characters are not therapists or counselors. If you are experiencing mental health issues, please seek help from a licensed professional or crisis hotline.
• Legal advice — Do not rely on AI-generated content for legal decisions. Consult a qualified attorney.
• Financial or investment advice — AI responses should not be used for financial planning or investment decisions.
• Professional guidance of any kind — This includes but is not limited to educational, career, technical, or relationship advice.

The Service may contain or generate content of an explicit, mature, or adult nature (NSFW), including but not limited to sexually suggestive text, AI-generated adult images, and mature themes in character interactions.

All Characters on the platform — whether created by TuringMate or by Users — are depicted as being 18 years of age or older. No Character on the Service represents, portrays, or is intended to depict any individual under the age of 18. Users are strictly prohibited from creating or configuring any Character that is described, implied, or portrayed as being under 18 years of age. Any such content will be removed and may result in immediate account termination.

By using the Service and confirming that you are at least 18 years of age, you acknowledge that:

• You may encounter mature or explicit content during your use of the Service.
• All Characters you interact with are depicted as adults (18 years of age or older).
• The availability and nature of such content is a known feature of the platform.
• You assume full responsibility for your interaction with such content.
• It is your responsibility to ensure that accessing such content is legal in your jurisdiction.

The Service includes facial recognition capabilities powered by AWS Rekognition. This technology:

• May produce inaccurate results, including false positives (incorrectly identifying someone) or false negatives (failing to recognize someone).
• Should not be relied upon for identity verification, security, or any critical decision-making.
• Is provided as an entertainment feature to enhance character interactions and is not intended for surveillance or identification purposes beyond the Service.

You are solely responsible for ensuring that any photos you upload containing other individuals' faces are shared with their consent. Uploading photos of individuals without their knowledge or consent may violate applicable laws.

AI-generated images produced through the Service (via Google Gemini, Qwen, and other models) are subject to the following limitations:

• Generated images are AI-created synthetic media. They do not depict real events, real locations, or real individuals (unless reference photos were provided by the user). All AI-generated character images depict individuals who are 18 years of age or older.
• Image generation may occasionally produce low-quality, distorted, or inappropriate results despite validation measures.
• We implement photo validation with multiple attempts, but cannot guarantee that all generated images will meet quality or appropriateness standards.
• You should not redistribute AI-generated images as photographs of real people.

The Service relies on numerous third-party services to operate, including but not limited to:

• Clerk for authentication and user management
• Google Gemini for AI text generation, embeddings, and image generation
• OpenAI for content moderation
• DeepSeek (via APIFree) for AI text generation
• Qwen-VL (via OpenRouter) for photo analysis
• Venice AI for vision analysis
• AWS (S3, Rekognition) for file storage and facial recognition
• Cloudinary for image storage and optimization
• MongoDB Atlas for database services
• Mixpanel for product analytics, session recordings, and heatmap data
• Vercel for hosting and infrastructure

We are not responsible for the availability, reliability, accuracy, or security of these third-party services. Outages, changes, or discontinuation of any third-party service may affect the functionality of the Service. We will make reasonable efforts to maintain service continuity but cannot guarantee uninterrupted operation.

Each third-party service has its own terms and privacy policies. We encourage you to review them. Links to relevant privacy policies are provided in our Privacy Policy.

The credit system is the sole method of payment for messaging services. By purchasing credits:

• You acknowledge that credits are non-refundable except as required by applicable law.
• Credits have no cash value and cannot be exchanged, sold, or transferred.
• Credit consumption occurs per message (1 credit for text, 2 credits for photo messages) regardless of message quality, AI response accuracy, or your satisfaction with the response.
• Credits consumed for messages involving AI errors, unexpected content, or service issues will not be automatically refunded.
• We reserve the right to change credit pricing at any time. Price changes apply to future purchases only.

If you use the TuringMate API or webhook features:

• The API is provided "as is" without guarantees of uptime, response time, or availability.
• Webhook delivery is made on a best-effort basis. We do not guarantee delivery of all webhook events.
• You are responsible for securing your API keys and webhook endpoints, including validating HMAC-SHA256 signatures on incoming webhooks.
• We may impose or modify rate limits at any time to protect service stability.
• API responses may include AI-generated content subject to the same disclaimers outlined in this document.
• If you serve TuringMate characters to your own end-users via the API, you are legally required to clearly disclose that all characters are AI-generated and not real people. You must not represent or imply that AI characters are human. Failure to make this disclosure may violate consumer protection laws in your jurisdiction and constitutes a breach of our Terms & Conditions.

We employ automated content moderation using OpenAI's moderation API and other safety measures to filter prohibited content. However:

• No moderation system is 100% accurate. Some inappropriate content may evade detection, and some legitimate content may be incorrectly flagged.
• We do not manually review all messages and AI-generated content in real time.
• You may encounter content that you find objectionable, offensive, or disturbing despite moderation measures.
• If you encounter prohibited content, please report it to support@turingmate.com.
